DMCA & Copyright Policy

1. Our policy

NXTRUNN respects intellectual-property rights and expects its users to do the same. We respond to clear notices of alleged copyright infringement under the U.S. Digital Millennium Copyright Act ("DMCA") and comparable laws in other jurisdictions, and we may remove infringing content and terminate repeat infringers.

2. Designated Copyright Agent

Notices of alleged infringement must be sent to our Designated Agent:

3. How to file a takedown notice (copyright owners)

To report content you believe infringes your copyright, send the Designated Agent a written notice that includes:

• Your physical or electronic signature;
• Identification of the copyrighted work you claim was infringed (or a representative list);
• Identification of the infringing material and information reasonably sufficient to locate it (e.g., the URL or post/photo ID on NXTRUNN);
• Your contact information (name, address, phone, email);
• A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; and
• A statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act on the owner's behalf.

Caution: Under 17 U.S.C. §512(f), knowingly materially misrepresenting that material is infringing can subject you to liability for damages. If you're unsure whether use is infringing (e.g., fair use), consult an attorney.

4. What we do with a valid notice

On receipt of a compliant notice, we will, as appropriate: remove or disable access to the material; take reasonable steps to notify the user who posted it; and provide them a copy of the notice. We may document the action in our moderation/audit records.

5. Counter-notification (users)

If your content was removed and you believe it was a mistake or misidentification, you may send a counter-notice to the Designated Agent including:

• Your physical or electronic signature;
• Identification of the removed material and the location where it appeared before removal;
• A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification;
• Your name, address, and phone number, and a statement that you consent to the jurisdiction of the U.S. federal court for your district (or, if outside the U.S., the courts of New Jersey, United States) and will accept service of process from the complainant.

If we receive a valid counter-notice, we may restore the material in 10–14 business days unless the complainant notifies us that they have filed a court action seeking to restrain the activity.

6. Repeat-infringer policy

We will, in appropriate circumstances and at our discretion, terminate accounts of users who are repeat infringers, and may remove infringing content and restrict features at any time.

7. Trademark and other IP

For trademark, publicity, or other (non-copyright) IP complaints, contact legal@nxtrunn.com with details of the right, the allegedly infringing content, and your authority to act. NXTRUNN's own marks, software, and design are owned by NXTRUNN LLC.

8. International

For copyright complaints under the EU Copyright Directive, UK CDPA, or other national laws, send equivalent information to the contact above; we will respond as required by applicable law.
